New Interpretative Case Opened
Interpretative Case No 3/2017 of the General Assembly of the Civil and Commercial Colleges of the Supreme Court of Cassation was opened with an order dated 30 June 2017 to examine three questions concerning the repayment of monetary debt, in particular bank loans. The first two questions refer to partial repayments: which part of the debt should be covered by the partial repayment (principal, interest, or costs) and whether the debtor is entitled to specify the debt that he repays with the partial repayment. The third question is the most important one in practical terms, asking whether early collection of a debt arising out of a loan includes the agreed remunerative interest rate or not.
